Merit Versus Race and Gender: A Constitutional & Ethical Critique of Identity-Based Hiring in Higher Education

Abstract

This paper critically evaluates Diversity, Equity, and Inclusion (DEI) hiring mandates in higher education and assesses their compatibility with constitutional and merit-based principles. Integrating constitutional law, empirical research, and ethical analysis, the study argues that DEI-driven frameworks redefine fairness from equality of opportunity to equality of outcomes, thereby conflicting with the Fourteenth Amendment, Title VII, and the Supreme Court’s 2023 Students for Fair Admissions decision. Empirical evidence, including meta-analyses on corporate diversity, DEI training, and hiring outcomes, reveals weak or negative effects, widespread reverse discrimination, and the proliferation of symbolic compliance mechanisms. The paper further demonstrates how outcome-driven hiring persists through proxy practices and disparate-impact reasoning, raising concerns for academic freedom, intellectual diversity, and institutional integrity. As an alternative, it advances Constructive Ethnic Studies, shared moral foundations, and viewpoint diversity as constitutionally sound pathways that promote genuine inclusion. The analysis concludes that race-neutral, merit-based hiring provides the most durable foundation for legal equality, academic excellence, and the core purposes of higher education.
